This Agreement is between you as the user of the HKCE Website and Harten-Kroeber Continuing Education (“HKCE”) and it governs your use of the HKCE Website and the associated HKCE programs and related services (collectively ”Services”).

The information, courses, artwork, text, software, photographs, graphics and all other intellectual property contained on the HKCE Website are protected by copyright, trademark, or other proprietary rights of HKCE or third party licensees of HKCE (“Content”). You may print, download, or otherwise reproduce one copy of the Content for your non-commercial personal or educational use. You agree that you will retain all copyright and other proprietary notices in or on the Content contained in the original on any copy you make. To receive continuing education credit for any course provided by HKCE, you must be a MFT or LCSW licensed by the State of California, or licensed by a governing body that accepts units earned from a California Board of Behavioral Sciences approved continuing education provider. It is your responsibility to keep informed of the current rules and regulations regarding your continuing education requirements. It is recommended that you contact your state licensing board for information on such continuing education rules and requirements. When taking continuing education courses you have made an agreement to complete the entire course and answer the post-test and evaluation questions truthfully. Upon submitting the course post-test and evaluation you are attesting to the fact that you completed the entire course, have answered all questions honestly, and have not received assistance from others.
You agree to provide complete, accurate and current information when you create an account with HKCE. You further agree to promptly update your account information as required to keep this information complete, accurate and current. You agree that HKCE may store and use the information you provide in maintaining your account. HKCE may terminate your rights to any or all of the Services, and may invalidate any continuing education courses taken, if the information you provide is false or inaccurate.
You are responsible for all activities that occur on or through your HKCE account, and you agree to immediately notify HKCE of any unauthorized use of your account or any other breach of security that comes to your attention. You are responsible for maintaining the security and confidentiality of your HKCE account and agree to keep your login and password private. You agree that HKCE shall not be liable for any losses resulting from the unauthorized use of your account.
You understand and agree that HKCE will require specific personal information when you create an account on the HKCE Website for the purposes of registering for an in-person workshop or online course, completing the post-test and evaluation for an online course, paying the fee for an in-person workshop or online course, or requesting the Certificate of Completion.
You shall use the Website for lawful purposes only. You shall not post or transmit via the Website any material that violates or infringes in any way upon the rights of others, that is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, that encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or that, without HKCE’s express prior approval, contains advertising or any solicitation with respect to products or services.
You agree to comply with all applicable laws, statutes, ordinances, and regulations regarding use of the HKCE Website and purchase of the Services from HKCE on the Website. The laws of California shall govern interpretation and enforcement of this agreement. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. HKCE’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.
In the event of a dispute between you and HKCE related to this Agreement or otherwise as to any matter not covered by this Agreement, you agree to first use reasonable efforts to attempt to settle such dispute by negotiation with HKCE. Any dispute, controversy, or claim arising out of, or concerning the interpretation or performance of this Agreement or otherwise between you and HKCE that cannot be resolved through negotiation shall be submitted to binding arbitration conducted in Santa Cruz County, California. California law shall apply to such arbitration or any other matter under this Agreement.
